STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT establishing a commission to study the marketing of e-cigarettes and e-liquid in this state, including the legality of available products, appropriate wholesale and retail compliance and tax collection system of the same.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Liquor Licenses and Fees; Commission to Study the Marketing of E-cigarettes and E-liquid.  Amend RSA 178 by inserting after section 31 the following new section:

178:32  Commission to Study the Marketing of E-cigarettes and E-liquid.

I.  There is established a commission to study the marketing of e-cigarettes and e-liquid in this state, including the legality of available products, appropriate wholesale and retail compliance and tax collection system of the same.

II.  Notwithstanding RSA 14:49. the members of the commission shall be as follows:

(a)  One member of the senate, appointed by the president of the senate.

(b)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

(c)  One representative of the department of revenue administration, appointed by the commissioner.

(d)   One representative of the liquor commission, appointed by the chairman.

(e)  Two members, appointed by the governor, engaged in the business wholesale and/or retail of tobacco products.

III.  Members of the commission shall serve without compensation, except that legislative members shall receive mileage at the legislative rate when attending to the duties of the commission.

IV.  The commission shall study the marketing of e-cigarettes and e-liquid in this state, including the legality of available products, appropriate wholesale and retail compliance and tax collection systems for such products.  The commission shall focus on the sales, marketing, enforcement and tax collection mechanisms of e-cigarettes and e-liquid pursuant to retail tobacco licensing set forth in RSA 178:19-a.  

V.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named senate member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Five members of the commission shall constitute a quorum.

VI.  The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2024.

2  Repeal.  RSA 178:32, relative to the commission to study the marketing of e-cigarettes and e-liquid, is repealed.

3  Effective Date.  

I.  Section 2 of this act shall take effect November 1, 2024.

II.  The remainder of this act shall take effect upon its passage.
