STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT relative to the tobacco use prevention and cessation program.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Youth Access to and Use of Tobacco; Tobacco Use Prevention and Cessation Program. Amend RSA 126-K:15 to read as follows:
126-K:15 Tobacco Use Prevention and Cessation Program.
I. There is hereby established in the department of health and human services the tobacco use prevention and cessation program, which shall be administered with funds appropriated to the department for such purpose, and which shall include but not be limited to:
[I.] (a) Tobacco use prevention community programs and grants.
[II.] (b) Tobacco use prevention school programs and grants.
[III.] (c) Tobacco use prevention state-wide programs and grants.
[IV.] (d) Tobacco use cessation programs.
[V.] (e) Tobacco use prevention and cessation counter marketing.
[VI.] (f) Evaluation of tobacco control initiatives.
[VII.] (g) Administration and enforcement.
II. In this section, "tobacco" includes e-cigarettes and liquid nicotine as those terms are defined in RSA 126-K:2.
2 Effective Date. This act shall take effect 60 days after its passage.

SB 422-FN- FISCAL NOTE
AN ACT relative to the tobacco use prevention and cessation program.
FISCAL IMPACT:
The Department of Health and Human Services states this bill, as introduced, may have an indeterminable impact on state expenditures in FY 2017 and each year thereafter. There will be no impact on county and local expenditures, or on state, county, and local revenue.
METHODOLOGY:
The Department of Health and Human Services states this bill updates RSA 126-K:15 by defining "tobacco" to include cigarettes and liquid nicotine. This change allows information about e-cigarettes and liquid nicotine to be included in existing tobacco use prevention programs and grants, tobacco use cessation programs, prevention and cessation counter marketing, evaluation of tobacco control initiatives, and administration and enforcement. The Department states the bill's fiscal impact is indeterminable but will likely be minimal. The program is currently funded through FY 2017 and operating with four positions. Materials used for the purposes defined in RSA 126-K:15 may need to be updated to include information related to e-cigarettes and liquid nicotine.
