This bill directs the Pease Development Authority, the department of fish and game and the department of transportation to study repairs to the Hilton Park boat ramp in Dover and the construction of a new dock facility for use by the public.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to the Hilton Park boat ramp.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1 Hilton Park Boat Ramp, Dock Repair, and Construction.

I.  The department of transportation, the department of fish and game, and the Pease Development Authority shall study repairs to the Hilton Park boat ramp and the construction of a new dock facility for use by the public.  The study shall include, but not be limited to consideration of the purchase of the site from the department of transportation and transfer to a suitable entity to oversee construction and operation of the facility, the cost of construction, the cost of maintenance, management of the completed facility, and any environmental impacts.  The study shall include consultation with the department of environmental services, the city of Dover, the town of Newington, the Great Bay waterkeeper, and other interested parties, and it shall provide opportunity for public input.  It shall consider available funds or grants from federal and other sources, and it shall address the issues of the potential use of the facility for commercial purposes.  The study shall consider feasible access and use under requirements of the Americans with Disabilities Act.  The study shall be completed by June 30, 2024.

II.  A report of the findings of the study shall be provided to the governor, the president of the senate, the speaker of the house of representatives, the department of transportation, the fish and game department, the Pease Development Authority, the chairs of the senate transportation committee, the senate energy and natural resources committee, the house fish and game and marine resources committee, and the house public works and highway committee.

2  Effective Date.  This act shall take effect upon its passage.

METHODOLOGY:

This bill, effective upon passage, requires the Department of Transportation and Fish and Game Department, along with the Pease Development Authority, to study repairs to the Hilton Park boat ramp and the construction of a new dock facility for use by the public. The study shall be completed by June 30, 2024.

 

The Department of Transportation estimates its costs for such a review would be $11,000, not including any consultant or appraisal fees. The Department did not identify the source of funds that would be used for this purpose.

 

The Fish and Game Department states:

  • Consultation with the stakeholder entities specified in this bill will identify a spectrum of site development scenarios for consideration and the cost to create and compile the information database (“scenario information”) specified for consideration in the study of the cost of construction, the cost of maintenance, the cost of management and administration of the completed site, and the cost of any environmental mitigation, if any, is indeterminable as there is no satisfactory technical and environmental site condition information available to form a basis for developing reasonable design and construction options for any potentially relevant stakeholder scenarios.
  • The consultation process may also identify additional specific concerns and conditions requiring investigation and evaluation and it is unclear which agency or entity will lead the study or bear the cost of the consultation and study process itself.  
  • After receiving input and comments during consultation with the stakeholder entities specified in this bill, the acquisition of scenario information, focused on a select few development options could begin subject to funding. Acquiring and assessing the scenario information will entail identifying and contracting with a qualified consultant that would subsequently develop a comprehensive evaluation plan for consideration by the state, followed by implementation.  
  • This process will take well over a year at least to accomplish as there may also be potential “time of year” constraints controlling the field investigation time-windows.  

 

Ultimately, total costs in FY 2023 and FY 2024 between the agencies to complete this study are unknown. It should also be noted this bill provides no new source of funding to complete the study.

 

The Pease Development Authority, Division of Ports and Harbors, states it is not expecting to incur any significant fiscal impact relative to this bill.
