STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
AN ACT establishing a commission relative to the minimum wage.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Minimum Wage Law; Minimum Hourly Rate. Amend the introductory paragraph in RSA 279:21 to read as follows:
Unless otherwise provided by statute, no person, firm, or corporation shall employ any employee at an hourly rate lower than that set forth in the federal minimum wage law, as amended, or as established by the minimum hourly rate commission established in RSA 279:21-b. Tipped employees of a restaurant, hotel, motel, inn or cabin, or ballroom who customarily and regularly receive more than $30 a month in tips directly from the customers will receive a base rate from the employer of not less than 45 percent of the applicable minimum wage. If an employee shows to the satisfaction of the commissioner that the actual amount of wages received at the end of each pay period did not equal the minimum wage for all hours worked, the employer shall pay the employee the difference to guarantee the applicable minimum wage. The limitations imposed hereby shall be subject to the following exceptions:
2 New Section; Minimum Wage Law; Minimum Hourly Rate Commission Established. Amend RSA 279 by inserting after section 21-a the following new section:
279:21-b Minimum Hourly Rate Commission Established.
I. There is established a minimum hourly rate commission which shall annually set and adjust the minimum hourly rate for employees. The members of the commission shall be as follows:
(a) Three members representing labor unions as follows: one member from the New Hampshire AFL-CIO appointed by that organization; one member from New Hampshire SEA/SEIU Local 1984 appointed by that organization; and one member from Teamsters Local 633 appointed by that organization.
(b) Three members representing business interests in this state, one of whom shall be appointed by the governor, one of whom shall be appointed by the speaker of the house of representatives, and one of whom shall be appointed by the president of the senate.
(c) Three members who shall be experts in the field of economics, one of whom shall be appointed by the governor, one of whom shall be appointed by the speaker of the house of representatives, and one of whom shall be appointed by the president of the senate.
II. The commission shall meet within 45 days of the effective date of this section to organize, elect a chairperson, and establish procedures, and may meet as often as it deems necessary thereafter. A simple majority shall be sufficient for the commission to conduct official business. No later than November 1, 2022, and annually thereafter the commission shall set the minimum wage for the following January 1, based on the most recent available information on cost of living and inflation as published by the United States Department of Labor, Bureau of Labor Statistics. The commission all advise the commissioner of the department of labor of the adjusted minimum hourly rate which shall become effective January 1. The rate set by the commission shall be in effect for one year.
3 Effective Date. This act shall take effect 60 days after its passage.
