AMENDED ANALYSIS

 

This bill authorizes the commissioner of the department of health and human services to contract with one or more physicians who are certified by an accredited addiction medicine or addiction psychiatry certifying body to review medication assisted treatment in New Hampshire.

 

The bill also authorizes the department of corrections to establish additional expenditure class lines with legislative fiscal committee and governor and council approval

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT enabling the department of health and human services to contract with certain certified physicians and authorizing the department of corrections to establish additional expenditure class lines with fiscal committee and governor and council approval.  

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Consultants to Review Medication Assisted Treatment.  Amend RSA 126-A:5 by inserting after paragraph XXX the following new paragraph:

XXXI.  The commissioner may enter into a contract or contracts with one or more physicians who are certified by an accredited addiction medicine or addiction psychiatry certifying body.  The physician or physicians shall provide consultation and guidance to the department related to designing, updating, and monitoring practices and policies regarding medication assisted treatment and related treatments for substance use disorders in New Hampshire.

2  New Paragraph; Parole of Prisoners.  Amend RSA 651-A:19 by inserting after paragraph VII the following new paragraph:

VIII.  Notwithstanding paragraph I or subparagraph VII(a) or (d), the parole board may impose a term of recommittal of less than 90 days for a prisoner whose arrest and parole revocation is determined by the board to be a result of or related to substance abuse, if the prisoner  enters and successfully completes a residential substance abuse treatment program deemed acceptable by the board and if the board determines that a recommittal of less than 90 days is necessary to assist the prisoner with substance abuse recovery.

3  New Paragraph; Transfer Language; Department of Corrections.  Amend RSA 9:16-a by inserting after paragraph IV the following new paragraph:

V.  Notwithstanding any provision of law to the contrary, the commissioner of the department of corrections is authorized to transfer funds within and among all accounting units within the department to create accounting units and expenditure classes as required and as the commissioner deems necessary and appropriate to address present or projected budget deficits, or to responds to changes in federal law, regulations, or programs, and otherwise as necessary for the efficient management of the department; provided if a transfer does not include new accounting units or expenditure classes, only transfers over $75,000 shall require prior approval of the fiscal committee of the general court and governor and council.

4  Effective Date.  

I.  Section 1 this act shall take effect 60 days after its passage.

II.  The remainder of this act shall take effect upon its passage.

METHODOLOGY:

This bill authorizes the Department of Health and Human Services to enter into a contract or contracts with one or more physicians to provide consultation related to designing, updating, and monitoring practices regarding medication assisted treatments for substance use disorders. The Department assumes the consultant will provide an estimated minimum of two hours per week during the first year of implementation, with consultation in subsequent years on an as-needed basis.  Based on a salary range of $105,000 to $225,000 per year, the Department assumes annual costs will be between $5,000 and $12,000, with a mean cost of $8,500.
