Short Title:      Nat. Guard/Adjutant General's Staff.

A BILL TO BE ENTITLED

AN ACT to provide that the terms of certain staff members' appointments shall last at least the period of time necessary for the staff members to vest in their appointed ranks for the purposes of retirement.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 127A‑19 reads as rewritten:

"§ 127A‑19.  Adjutant General.General and staff members.

(c)        Subject to the approval of the Governor and in consultation with the Secretary of Public Safety, the Adjutant General may appoint:

(1)        A deputy adjutant general, who may hold the same rank as the Adjutant General.

(2)        Two assistant adjutants general for the Army National Guard and an assistant adjutant general for the Air National Guard, each of whom may hold the rank of brigadier general.

The appointees authorized by this subsection shall serve at the pleasure of the Governor. The Adjutant General may also appoint or employ staff members and other personnel as authorized by the Secretary of Public Safety and funded.

(d)       The term of a staff member's appointment to the position of Director Joint Staff, Chief of Staff Army – North Carolina Army National Guard, Chief of Staff Air – North Carolina Air National Guard, a Command Senior Enlisted Leader, or a Command Chief Warrant Officer shall last at least the period of time necessary for the staff member to vest in the staff member's appointed rank for the purposes of retirement at that rank."

SECTION 2.  This act is effective when it becomes law and applies to appointments made on or after that date.
