Short Title:        DOT/Purchase of Contaminated Land.‑AB		(Public)

A BILL TO BE ENTITLED

AN ACT to exempt the department of Transportation from the prohibition on purchase of contaminated property by Public entities, as recommended by the Department of Transportation.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 133‑40(a) is rewritten to read:

"(a)       For purposes of this Article, the term "public entity" means the State and the Community College System.System, provided, however, that the term does not include the Department of Transportation in the exercise of the powers conferred by G.S. 136‑19."

SECTION 2.  This act is effective when it becomes law.
