A BILL TO BE ENTITLED

AN ACT restoring net general fund appropriations for the state alcohol and drug abuse treatment centers by directing the office of state budget and management, in conjunction with the department of health and human services, to realign affected base budgets to ensure that funds appropriated to the department of health and human services, division of mental health, developmental disabilities, and substance abuse services, for allocation to local management entities/managed care organizations are directly allocated to the state alcohol and drug abuse treatment centers.

The General Assembly of North Carolina enacts:

SECTION 1.  Section 12F.12 of S.L. 2015‑241 is repealed.

SECTION 2.  It is the intent of the General Assembly to restore net General Fund appropriations for the State Alcohol and Drug Abuse Treatment Centers operated under the authority of the Secretary of Health and Human Services pursuant to G.S. 122C‑181. Further, it is the intent of the General Assembly that the State Alcohol and Drug Abuse Treatment Centers resume the management and provision of those publicly funded substance abuse services as previously managed and delivered through the State Alcohol and Drug Abuse Treatment Centers prior to enactment of S.L. 2015‑241.

To this end, and notwithstanding any other provision of law, the Office of State Budget and Management, in conjunction with the Department of Health and Human Services, shall realign the affected Department of Health and Human Services base budgets to ensure that funds appropriated to the Department of Health and Human Services, Division of Mental Health, Developmental Disabilities, and Substance Abuse Services, for allocation to the local management entities/managed care organizations for each year of the 2017‑2019 fiscal biennium, be directly allocated to the State Alcohol and Drug Abuse Treatment Centers.

Notwithstanding any other provision of law, beginning with the 2017‑2018 fiscal year, the Office of State Budget and Management, in conjunction with the Department of Health and Human Services, shall amend and certify the affected Department of Health and Human Services base budgets.

SECTION 3.  This act becomes effective July 1, 2017.
