A BILL TO BE ENTITLED

AN ACT to authorize counties thaT PROVIDE ELECTRONIC MONITORING FOR OFFENDERS to collect a fee to recover the actual costs of providing THAT monitoring.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 28 of Chapter 7A of the General Statutes is amended by adding a new section to read:

"§ 7A‑313.1.  Fee for costs of electronic monitoring.

A county that provides the personnel, equipment, and other costs of providing electronic monitoring as a condition of an offender's bond or pretrial release may collect a fee from the offender of no more than the actual costs of providing the electronic monitoring."

SECTION 2.  This act becomes effective July 1, 2011.
