A BILL TO BE ENTITLED
AN ACT to allow the driver of a vehicle to overtake and pass slower moving vehicles on portions of the highway which are marked by signs, markers, or markings placed by the department of transportation stating or clearly indicating that passing should not be attempted.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 20‑150(e) reads as rewritten:
"(e) TheUnless the following conditions
exist, the driver of a vehicle shall not overtake and pass another on any
portion of the highway which is marked by signs, markers or markings placed by
the Department of Transportation stating or clearly indicating that passing
should not be attempted.attempted:
(1) The slower moving vehicle to be overtaken and passed is proceeding at less than half the speed of the posted speed limit.
(2) The faster moving vehicle is capable of overtaking and passing the slower moving vehicle without exceeding the posted speed limit.
(3) The faster moving vehicle is capable of overtaking and passing at least three feet to the left of the slower moving vehicle.
(4) The left side of the center of the highway is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit the overtaking and passing to be made in safety."
SECTION 2. G.S. 20‑149(a) reads as rewritten:
"(a) The driver of any such vehicle overtaking
another vehicle proceeding in the same direction shall pass at least two feet
to the left thereof, and shall not again drive to the right side of the highway
until safely clear of such overtaken vehicle. This subsection shall not apply
when the overtaking and passing is done pursuant to the provisions of G.S. 20‑150.1.G.S. 20‑150(e)
or G.S. 20‑150.1."
SECTION 3. This act becomes effective December 1, 2015, and applies to offenses committed on or after that date.
