GENERAL ASSEMBLY OF NORTH CAROLINA

HOUSE BILL 243
AN ACT to clarify that the fee charged by the clerk of superior court for certificates under seal is waived for appointed attorneys representing indigent clients.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 7A‑308(b1) reads as rewritten:
"(b1) The fees set forth
in subdivisionsubdivisions (9) and (12) of subsection (a) of this
section are not chargeable when copies or certificates under seal are
requested by an attorney who has been appointed or who is under contract with
the Office of Indigent Defense Services to represent an indigent person at
State expense, if the request is made in connection with the appointed case or
the contract and during the duration of the appointment or the contract."
SECTION 2. This act becomes effective July 1, 2011, and applies to fees assessed or collected on or after that date.
In the General Assembly read three times and ratified this the 15th day of June, 2011.
