AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF RANKIN COUNTY, MISSISSIPPI, TO SPECIFY THE HOURS OF OPERATION OF FACILITIES THAT SELL ALCOHOLIC BEVERAGES IN A CERTAIN QUALIFIED RESORT AREA LOCATED IN THE RESERVOIR COMMUNITY DISTRICT, SPECIFY THE PERCENTAGE OF REVENUE THAT FACILITIES THAT OFFER ALCOHOLIC BEVERAGES FOR SALE MUST DERIVE FROM THE PREPARATION, COOKING AND SERVING OF MEALS AND NOT FROM THE SALE OF BEVERAGES IN SUCH QUALIFIED RESORT AREA, AND DESIGNATE THE AREAS IN WHICH FACILITIES THAT OFFER ALCOHOLIC BEVERAGES FOR SALE MAY BE LOCATED IN SUCH QUALIFIED RESORT AREA; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Rankin County, Mississippi, with respect to the qualified resort area defined in Section 67-1-5(o)(iii)8.b. that is located in the Reservoir Community District in Rankin County, is authorized and empowered, in its discretion, to by ordinance:

          (a)  Specify the hours of operation of facilities that offer alcoholic beverages for sale;

          (b)  Specify the percentage of revenue that facilities that offer alcoholic beverages for sale must derive from the preparation, cooking and serving of meals and not from the sale of beverages;

          (c)  Designate the areas in which facilities that offer alcoholic beverages for sale may be located.

     (2)  Pursuant to this section, the Board of Supervisors of Rankin County, Mississippi, may only exercise the powers authorized in Section 1 of this act with regard to a qualified resort area located in the unincorporated area of Rankin County and may not exercise such powers with regard to a qualified resort area located in any municipality or water supply district.   SECTION 2.  This act shall take effect and be in force from and after its passage.
