AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF JACKSON, MISSISSIPPI, TO REGULATE AND PROHIBIT THE PLACEMENT AND USE OF PRIVATE WATER WELLS WITHIN THE BOUNDARIES OF THE MUNICIPAL UTILITY SERVICE AREA; TO PROVIDE THAT CERTAIN WATER WELLS SHALL BE EXEMPT FROM ANY REGULATION AND PROHIBITION AUTHORIZED BY THIS ACT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Except as provided in subsection (2) of this section, the governing authorities of the City of Jackson, Mississippi, are authorized and empowered, in their discretion, to regulate and prohibit the placement and use of private water wells within the boundaries of the municipal utility service area.
(2) Private water wells utilized by hospitals and private property owners that are in operation before the effective date of this act shall be exempt from any regulation and prohibition authorized by subsection (1) of this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
