AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF A CERTAIN COUNTY TO ALLOW OFF-DUTY LAW ENFORCEMENT OFFICERS TO USE COUNTY VEHICLES AND TO RECEIVE COMPENSATION FROM PRIVATE ENTITIES FOR PERFORMING TRAFFIC CONTROL SERVICES ON PUBLIC OR PRIVATE STREETS NEAR CONSTRUCTION SITES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The board of supervisors of any county bordering on the Gulf of Mexico and the State of Alabama may allow off-duty certified law enforcement officers, certified part-time law enforcement officers and noncertified law enforcement officers, as defined in Section 45-6-3, to receive compensation from private entities for the sole purpose of performing traffic control services on public or private streets near construction zones.  During such private employment, the off-duty officers may wear the official uniform and may utilize the official firearm issued by the law enforcement jurisdiction in accordance with the provisions of Section 17-25-11.  The board of supervisors may approve the use of a county vehicle in connection with the private employment authorized in this section, provided that mileage will be reimbursed to the county at the rate provided in Section 25-3-41 and that such off-duty officers will be required to purchase individual liability and property damage policies covering the use of the vehicles outside the course and scope of their employment.  The board of supervisors shall, by resolution, adopt specific policies and procedures governing the off-duty employment authorized in this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
