MISSISSIPPI LEGISLATURE

AN ACT TO AUTHORIZE THE SECRETARY OF STATE TO DONATE CERTAIN SUBMERGED LANDS LOCATED IN JACKSON COUNTY, MISSISSIPPI, TO THE NATIONAL PARK SERVICE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Secretary of State is hereby authorized to transfer and reconvey by means of donation to the National Park Service certain submerged lands located in Davis Bayou situated in Section 33, Township 7 South, Range 8 West, Mississippi Sound, Jackson County, State of Mississippi, and being more particularly described as follows:

BEGINNING at a point of intersection of the mean high water line of Davis Bayou along lands owned by the United States of America, (National Park Service Tract Number 03-120) with a line ten feet southerly of and parallel with the outer southerly edge of an existing boat dock on Davis Bayou, lying just South of an existing concrete boat ramp:

Thence across submerged lands, S 45° 00' 00" W, along a line ten feet distant from and parallel with said outer southerly edge of the main portion of said boat dock, for a distance of 188.55 feet more or less to a point bearing N 45° 00' 00" E, a distance of 77.41 feet more or less from the intersection with the extension of a line ten foot distant from and parallel with the westerly edge of an existing boat dock;

Thence due West, for a distance of 86.34 feet more or less to the intersection with said extension of a line ten feet distant from and parallel with the outer westerly edge of an existing boat dock;

Thence N 30° 00' 00" W, along said parallel line, for a distance of 146.22 feet more or less, to the intersection of said parallel line with a line ten feet distant from and parallel with the outer southerly line of an existing boat dock;

Thence due West, along said parallel line, for a distance of 28.84 feet more or less, to the intersection of said parallel line with a line ten feet distant from and parallel with the outer westerly line of an existing boat dock;

Thence N 30° 00' 00" W, along said parallel line, for a distance of 89.08 feet more or less, to the intersection of said parallel line with a line ten feet distant from and parallel with the outer northerly line of an existing boat dock;

Thence N 30° 00' 00" E, along said parallel line, for a distance of 137.93 feet more or less, to the intersection of said parallel line with the mean high water line of Davis Bayou along lands owned by the United States of America, (National Park Service Tract Number 03-121);

Thence, along said mean high water line of Davis Bayou in a southeasterly direction approximately 328 feet returning to the Point of Beginning.

Any deviations from the main or overall trend or bearing of the edge of a dock; such as a bump-out or widening of a portion of the dock and the change of direction at the very end of a dock are not to be considered when establishing these ten foot parallel lines. The intent of keeping ten feet distant from the outer edge of the existing boat dock(s) was to compensate for any such deviations.

Containing 1.40 acres, more or less.

Being a part of the lands owned by the State of Mississippi as provided by the Submerged Lands Act,

43 U.S.C., Section 1311- Rights of States, and case findings of the Phillips Petroleum v. Mississippi,

484 U.S. 469 (1988).

     (2)  The State of Mississippi shall retain all mineral rights to the real property sold or leased under this section.

     (3)  The Secretary of State is further authorized to execute, with the approval of the Governor, any agreements, deed and other documents necessary to complete the property donation authorized under subsection (1) of this section.  The Secretary of State may correct any discrepancies in the legal description of the property provided in this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
