Senate Bill 2742

AN ACT TO REQUIRE A UNANIMOUS VOTE OF THE GOVERNING AUTHORITY OF A MUNICIPALITY TO REMOVE CERTAIN PERSONS FROM POSITIONS THAT ARE APPOINTED BY SUCH GOVERNING AUTHORITY; TO AUTHORIZE REMOVAL UPON A MAJORITY VOTE OF THE GOVERNING AUTHORITY OF THE MUNICIPALITY IF REMOVAL IS RECOMMENDED BY THE ENTITY TO WHICH THE PERSON WAS APPOINTED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Unless the term of appointment has expired or has otherwise been terminated, any person who has been appointed to a position on any board, commission, council or committee by the governing authority of a municipality may be removed from that position:

          (a)  Upon a unanimous vote of the appointing authority; or

          (b)  Upon a majority vote of the appointing authority after a recommendation from the board, commission, council or committee to which the person was appointed that the person should be removed.

     (2)  The provisions of this section shall apply to all municipalities of this state, whether operating under the code charter, a special charter, commission form, or other form of government.

     (3)  The provisions of this section shall be supplemental to any other provisions in law that provide for the removal of a person appointed by the governing authority of a municipality.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
