Senate Bill 2728

AN ACT TO AMEND SECTION 65-21-1, MISSISSIPPI CODE OF 1972, TO MAKE THE PLACEMENT OF GUIDES OR WARNING POSTS ON CULVERTS A DISCRETIONARY DUTY OF THE MISSISSIPPI TRANSPORTATION COMMISSION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 65-21-1, Mississippi Code of 1972, is amended as follows:

     65-21-1.  All culverts * * *hereafter built, rebuilt, or placed in any public road in this state shall be not less than the full width of the crown of the roadway, and * * *shall may have guides or warning posts on either side as deemed necessary by the Mississippi Transportation Commission.  All bridges * * *hereafter built, rebuilt, or placed in any public road of this state shall be built the full width of the crown of the roadway where the same is sixteen (16) feet wide or less, and on roads having a greater width than sixteen (16) feet the bridges shall be not less than sixteen (16) feet wide; and all bridges * * *hereafter built or rebuilt shall be built with banisters on * * * either both sides.  This section shall not apply to temporary bridges and culverts on detours; and all public highways in this state within the area of, or contingent to, any national reforestation project, which have been or may be taken over, constructed, or reconstructed by * * *this a department of the national government, may have bridges or culverts the width of * * *said the highways, but not less than twelve (12) feet.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
