Senate Bill 2704

AN ACT TO DEFINE CRITERIA FOR CITIZENSHIP IN THE STATE OF MISSISSIPPI; TO CLARIFY THAT THE STATUS OF CITIZENSHIP IN MISSISSIPPI SHALL NOT CONFER ANY RIGHT, PRIVILEGE, IMMUNITY OR BENEFIT UNDER LAW; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  A person is a citizen of the State of Mississippi if:

          (a)  The person is born in the United States and subject to the jurisdiction thereof; and

          (b)  The person is a resident of the State of Mississippi, as defined by the decisions of the Mississippi Supreme Court.

     (2)  For the purposes of this statute, "subject to the jurisdiction of the United States" has the meaning that it bears in Section 1 of the Fourteenth Amendment to the United States Constitution, namely that the person is a child of at least one (1) parent who owes no allegiance to any foreign sovereignty, or a child without citizenship or nationality in any foreign country.  For the purposes of this statute, a person who owes no allegiance to any foreign sovereignty is a United States citizen or national, or an immigrant accorded the privilege of residing permanently in the Untied States, or a person without citizenship or nationality in any foreign country.

     (3)  In addition to the criteria of citizenship described under subsections (1) and (2), a person is a citizen of the State of Mississippi if:

          (a)  The person is naturalized in the United States; and

          (b)  The person is a resident of the State of Mississippi, as defined by the decisions of the Mississippi Supreme Court.

     (4)  Citizenship of the State of Mississippi shall not confer upon the holder thereof any right, privilege, immunity or benefit under law.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
