AN ACT TO PROHIBIT DISCRIMINATION IN THE WORKPLACE ON THE BASIS OF RACE, COLOR, RELIGION, SEX, NATIONAL ORIGIN, AGE OR DISABILITY; TO PROHIBIT RETALIATION; TO ESTABLISH A STATUTE OF LIMITATION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  This act may be cited as the "Mississippi Anti-Discrimination in Employment Act."

     SECTION 2.  (1)  It shall be unlawful for any employer to discriminate on the basis of race, color, religion, sex, national origin, age or disability.

     (2)  Retaliation against any individual for opposing a discriminatory practice, or for filing a complaint or participating in the investigation of a complaint shall be unlawful.

     (3)  For purposes of this section, employer includes public and private employers, labor unions and employment agencies.

     (4)  A court may award compensatory damages and injunctive relief against an employer guilty of violating the provisions of this act.  Punitive damages may be available against nongovernmental employers.

     (5)  All actions under this section shall be commenced within two (2) years next after the cause of such action accrued.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2011.
