AN ACT TO AMEND SECTIONS 37-139-1 THROUGH 37-139-13, MISSISSIPPI CODE OF 1972, AND TO CODIFY SECTION 37-139-2, MISSISSIPPI CODE OF 1972, TO TRANSFER AND MERGE THE ADMINISTRATION AND PROGRAMS OF THE MISSISSIPPI SCHOOL FOR MATHEMATICS AND SCIENCE AT THE MISSISSIPPI UNIVERSITY FOR WOMEN TO THE MISSISSIPPI SCHOOL OF THE ARTS IN BROOKHAVEN, MISSISSIPPI, ON JULY 1, 2011; TO PROVIDE THAT THE MISSISSIPPI SCHOOL FOR MATHEMATICS AND SCIENCE SHALL BE ADMINISTERED BY THE STATE BOARD OF EDUCATION ACTING THROUGH THE MISSISSIPPI SCHOOL OF THE ARTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 37-139-1, Mississippi Code of 1972, is amended as follows:

     37-139-1.  As used in this chapter, the following terms shall have the meanings ascribed herein, except when the context clearly indicates a different meaning:

          (a)  "Board" means the State Board of Education acting through the Mississippi School for Mathematics and Science at the Mississippi University for Women.

          (b)  "School" means the Mississippi School for Mathematics and Science.

     SECTION 2.  The following provision shall be codified as Section 37-139-2, Mississippi Code of 1972:

     37-139-2.  Effective July 1, 2011, the Mississippi School for Mathematics and Science on the campus of the Mississippi University for Women shall be transferred to and merged with the existing facilities of the Mississippi School of the Arts in Brookhaven, Mississippi.  The State Superintendent of Education, with the approval of the State Board of Education, shall have the authority to employ staff and expend funds authorized for the continued operation of the Mississippi School for Mathematics and Science.  All records, personnel, property and unexpended balances of appropriations, allocations or other funds for the Mississippi School for Mathematics and Science on the campus of Mississippi University for Women shall be transferred to the Mississippi School of the Arts in Brookhaven according to the merger of their functions under this act.  All personnel actions initiated as a result of this merger shall be subject to State Personnel Board procedures, if applicable.  The State Board of Education is authorized and empowered to promulgate all reasonable rules and regulations necessary to accomplish an orderly transition pursuant to the terms of this act.

     SECTION 3.  Section 37-139-3, Mississippi Code of 1972, is amended as follows:

     37-139-3.  (1)  There is hereby created the Mississippi School for Mathematics and Science which shall be a residential school for eleventh and twelfth grade high school students operated as a division of the Mississippi School of the Arts located in Brookhaven, Mississippi.

     (2)  The school shall be governed by the State Board of Education.

     (3)  The board shall develop a plan relating to the opening, the operation and the funding of the school.  Such plan * * * shall include an equitable and reasonable plan for student recruitment without regard to race, creed or color.

     (4)  The purpose of the school shall be to educate the gifted and talented students of the state, and its curriculum and admissions policies shall reflect such purpose.

     (5)  The board shall prepare the annual budget for the school.

     (6)  From and after July 1, 2011, all powers and duties granted hereunder to the State Board of Education for the administration of the Mississippi School for Mathematics and Science shall be transferred to the Mississippi School of the Arts and the board shall contract as necessary with the trustees of the property on which the Mississippi Arts is located regarding the administration of the Mississippi School for Mathematics and Science.

     SECTION 4.  Section 37-139-5, Mississippi Code of 1972, is amended as follows:

     37-139-5.  The Director of the Mississippi School of the Arts shall be the Chief Administrative Officer of the Mississippi School for Mathematics and Science who acting through the Mississippi School of the Arts shall administer the school in accordance with policies established by the board.  The director shall be responsible for such administrative duties and functions as the board shall so prescribe.  The board shall be authorized, in its discretion, to delegate to the director such of its powers and duties as it deems appropriate.

     SECTION 5.  Section 37-139-7, Mississippi Code of 1972, is amended as follows:

     37-139-7.  The board shall be authorized to solicit and utilize the staff of the State Department of Education * * * and other state agencies as required for the implementation of this chapter.  In addition, the board shall be authorized to contract or enter into agreements with other agencies and/or private research centers that it may deem necessary to carry out its duties and functions.

     SECTION 6.  Section 37-139-9, Mississippi Code of 1972, is amended as follows:

     37-139-9.  The board acting through the Mississippi School of the Arts shall be the exclusive governing body of the Mississippi School for Mathematics and Science and is hereby authorized and empowered to promulgate rules and regulations required to carry out the provisions of this chapter.  The emphasis of this school shall be dedicated to the academic teaching of mathematics and the sciences, but shall not preclude some emphasis being placed on the arts and humanities as deemed appropriate by the board.

     SECTION 7.  Section 37-139-11, Mississippi Code of 1972, is amended as follows:

     37-139-11.  For the operation and support of the Mississippi School for Mathematics and Science, the board acting through the Mississippi School of the Arts is authorized and empowered to receive contributions, donations, gifts, bequests of money, other forms of financial assistance and/or property, equipment, materials or manpower from persons, foundations, trust funds, corporations, organizations and other sources, private or public, to be expended and utilized by said board in carrying out the provisions of this chapter.

     SECTION 8.  Section 37-139-13, Mississippi Code of 1972, is amended as follows:

     37-139-13.  All expenditures for the Mississippi School for Mathematics and Science shall be authorized by the board.  Such expenditures shall be paid therefrom by the State Treasurer on warrants issued by the State Fiscal Management Board.  Said State Fiscal Management Board shall issue its warrant upon requisition signed by the proper person, officer or officers in the manner provided by law.

     SECTION 9.  This act shall take effect and be in force from and after July 1, 2010.
