AN ACT TO CREATE THE TAX SALE OF LAND REFORM TASK FORCE TO STUDY THE LAWS REGARDING THE SALE OF LAND FOR DELINQUENT AD VALOREM TAXES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  There is created the Tax Sale of Land Reform Task Force to study and assess the laws regarding the sale of land for delinquent taxes.  The study shall include, but not be limited to, an examination of the possibility of the creation of a fund for counties to access to purchase land being sold for delinquent ad valorem taxes and methods of ensuring that notices of such sales are received by delinquent taxpayers.

     (2)  The task force shall be composed of the following members:

          (a)  Five (5) members of the House of Representatives appointed by the Speaker of the House of Representatives.

          (b)  Five (5) members of the Senate appointed by the Lieutenant Governor.

          (c)  The President of the Mississippi Chancery Clerk's Association, or his designee.

          (d)  The President of the Mississippi Assessors and Collectors Association, or his designee.

          (e)  The Secretary of State, or his designee.

     (3)  The Secretary of State shall serve as chairman of the task force.  The task force shall meet at the call of the chairman and at its first meeting shall select a vice chairman from among its membership.  The vice chairman shall also serve as secretary of the task force and shall be responsible for keeping all records of the task force.  A majority of the members of the task force shall constitute a quorum.

     (4)  The task force shall file a report with the Clerk of the House of Representatives and the Secretary of the Senate containing its findings and recommendations by not later than December 1, 2010.

     (5)  Legislative members of the committee shall receive per diem, travel or other expenses, if authorized by the Management Committees of the House of Representatives and the Senate, from the contingent expense funds of their respective houses in the same amounts as provided for committee meetings when the Legislature is not in session; provided that no per diem or expense for attending meetings of the committee shall be paid while the Legislature is in session.

     (6)  Nonlegislative members of the task force shall receive no compensation for their service on the task force but may be reimbursed for expenses related to their service on the task force as authorized by law.

     (7)  The task force shall use clerical and legal staff already employed by the Legislature and any other staff assistance made available to it.  To effectuate the purposes of this section, any department, division, board, bureau, commission or agency of the state or of any political subdivision thereof shall, at the request of the chairman of the task force, provide to the task force such facilities, assistance and data as will enable the task force properly to carry out its duties.

     (8)  The task force shall be dissolved on December 1, 2010.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
