AN ACT RELATING TO FOOD STAMP REFORM; TO PROHIBIT THE MISSISSIPPI DEPARTMENT OF HUMAN SERVICES FROM APPLYING OR RENEWING ANY WORK REQUIREMENT WAIVER UNDER THE SUPPLEMENTAL NUTRITIONAL ASSISTANCE PROGRAM (SNAP); TO PROVIDE THAT CATEGORICAL ELIGIBILITY SHALL NOT BE GRANTED BY THE DEPARTMENT OF HUMAN SERVICES FOR SNAP BENEFITS UNLESS EXPRESSLY REQUIRED BY FEDERAL LAW; TO REQUIRE THE DEPARTMENT OF HUMAN SERVICES TO CONTINUE TO IMPLEMENT INCOME THRESHOLDS AND ASSET TESTS AS A CONDITION FOR THE RECEIPT OF SNAP BENEFITS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Mississippi Department of Human Services shall not seek, apply for, accept or renew any waiver of work requirements for the Supplemental Nutritional Assistance Program (SNAP) under 7 USC Section 2015(o), unless expressly required by federal law.
(2) In no case shall categorical eligibility under 7 USC Section 2014(a) be granted by the Mississippi Department of Human Services for benefits under the Supplemental Nutritional Assistance Program or for any noncash, in-kind or other benefit unless expressly required by federal law.
(3) In no case shall the Mississippi Department of Human Services allow the gross income standards of the SNAP program to exceed the standards specified in 7 USC Section 2014(c) unless expressly required by federal law. In no case shall categorical eligibility exempting households from the gross income standard requirements be granted for the SNAP program or for any noncash, in-kind or other benefit unless expressly required by federal law.
(4) In no case shall the Mississippi Department of Human Services allow the resource limit standards of the SNAP program to exceed the standards specified in 7 USC Section 2014(g)(1) unless expressly required by federal law. In no case shall categorical eligibility exempting households from these resource limits be granted by the department for any SNAP or other noncash, in-kind or other benefit unless expressly required by federal law.
SECTION 2. This act shall take effect and be in force from and after July 1, 2015.
