Senate Bill 2390

AN ACT TO AMEND SECTION 33-13-451, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT ALL MEMBERS OF THE STATE MILITARY FORCES, NOT IN TITLE 10 FEDERAL SERVICE, MAY BE TRIED OR PUNISHED UNDER THE PUNITIVE SECTIONS OF THE MISSISSIPPI CODE OF MILITARY JUSTICE, REGARDLESS OF THEIR DUTY STATUS, UNTIL SUCH PERSON'S SERVICE HAS BEEN TERMINATED IN ACCORDANCE WITH LAW OR REGULATION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 33-13-451, Mississippi Code of 1972, is amended as follows:

     33-13-451. * * *  No person  All members of the state military forces, not in Title 10 federal service, may be tried or punished for any offense provided for in Sections 33-13-451 through 33-13-529 of this code, * * * unless it was committed while he was in a regardless of their duty status * * * or during a period of time when he was under lawful orders to be in a duty status, until such person's service has been terminated in accordance with law or regulation.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
