AN ACT TO AMEND SECTIONS 37-20-1 THROUGH 37-20-9, MISSISSIPPI CODE OF 1972, TO AUTHORIZE AND DIRECT THE STATE BOARD OF EDUCATION TO ADOPT RULES REGARDING STUDENT COLLEGE READINESS EVALUATION AND REMEDIAL EDUCATION OPPORTUNITIES; TO PROVIDE THAT REMEDIAL INSTRUCTION SHALL BE A COLLABORATIVE EFFORT BETWEEN SECONDARY AND POSTSECONDARY EDUCATIONAL INSTITUTIONS; TO PROVIDE A FORMULA AND AUTHORIZE ALLOCATION OF FUNDS TO SCHOOLS FOR REMEDIAL EDUCATION; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 37-20-1, Mississippi Code of 1972, is amended as follows:
37-20-1. This chapter shall be known and may be cited as the "Mississippi Remedial Education Act of 2012."
SECTION 2. Section 37-20-3, Mississippi Code of 1972, is amended as follows:
37-20-3. The purpose of this chapter is to strengthen students' readiness for college and careers and expand readiness assessments, common placement testing for postsecondary education, and extended opportunities for remediation to high school seniors. The important goals of this chapter are to (a) increase the number and percentage of students who graduate from high school "college and career-ready"; (b) better communicate with 11th Grade students and their parents the requirements and opportunities for enrollment in college-credit courses without remediation; and (c) provide those students whose test scores in reading, writing and/or mathematics indicate any gaps with an opportunity to attain needed competencies in 12th Grade prior to high school graduation, in order to promote student retention and completion in college. * * *
SECTION 3. Section 37-20-5, Mississippi Code of 1972, is amended as follows:
37-20-5. (1) The State Board of Education shall adopt rules that require high schools to evaluate before the beginning of Grade 12 the college readiness of each student who indicates an interest in postsecondary education and scores at Level 2 or Level 3 on the reading portion of the Grade 10 MCAT or Level 2, Level 3 or Level 4 on the mathematics portion of the Grade 10 MCAT. High schools shall perform this evaluation using results from the corresponding component of the common placement test prescribed in this section, or an equivalent test identified by the State Board of Education. The State Department of Education shall purchase or develop the assessments necessary to perform the evaluations required by this subsection and shall work with the school districts to administer the assessments. The State Board of Education shall establish by rule the minimum test scores a student must achieve to demonstrate readiness. Students who demonstrate readiness by achieving the minimum test scores established by the State Board of Education and enroll in a community college within two (2) years of achieving such scores shall not be required to enroll in remediation courses as a condition of acceptance to any community college. The high school shall use the results of the test to advise the students of any identified deficiencies and to the maximum extent practicable provide 12th Grade students access to appropriate remedial instruction prior to high school graduation. The remedial instruction provided under this subsection shall be a collaborative effort between secondary and postsecondary educational institutions. To the extent courses are available, the Mississippi Virtual School may be used to provide the remedial instruction required by this subsection.
(2) The funds which may be appropriated annually for this chapter shall be based on a formula developed by the State Board of Education and allocated to each school district * * *.
SECTION 4. Section 37-20-7, Mississippi Code of 1972, is amended as follows:
37-20-7. (1) To be eligible to receive funds under this chapter a school district shall describe in writing its remedial education program in compliance with the provisions of Section 37-20-5(1). * * *

SECTION 5. Section 37-20-9, Mississippi Code of 1972, is amended as follows:
37-20-9. (1) The State Department of Education shall provide technical assistance to districts and carry out the responsibilities of reviewing, monitoring and evaluating the programs conducted under this chapter.
(2) The State Board of Education shall adopt rules which, in its opinion, are necessary to assure that the programs in each school district are carried out in a manner consistent with the purpose and intent of this chapter. * * *
SECTION 6. This act shall take effect and be in force from and after July 1, 2012.
