Senate Bill 2088
AN ACT TO PROVIDE EMERGENCY DUTY LEAVE TO STATE EMPLOYEES WHO ARE MEMBERS OF ANY RESERVE COMPONENT OF THE UNITED STATES ARMED FORCES AND WHO ARE ORDERED TO ACTIVE DUTY DURING A STATE DECLARED EMERGENCY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1.
Any employee, as defined in Section 25-3-91, who is a member of any reserve
component of the Armed Forces of the United States and is ordered to active
duty during a state of emergency proclaimed by the Governor shall receive state
emergency duty leave during the duration of the emergency in an amount not to
exceed seven (7) days per calendar year. Such leave shall not accrue to the
employee and any unused days remaining in one (1) calendar year shall not
accrue to the next calendar year. No unused emergency duty leave may be
counted as creditable service for the purposes of the retirement system as
provided in
Sections 25-11-103 and 25-13-5. An employee is entitled to the leave for each
emergency regardless of the number of emergencies declared, provided that the
leave does not exceed the seven-day limitation per calendar year. An employee
may choose to take personal or other accrued leave for the period of emergency
service.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
