AN ACT TO AUTHORIZE THE CLARKSDALE PUBLIC UTILITIES COMMISSION TO BE ABOLISHED BY A MAJORITY VOTE OF THE QUALIFIED ELECTORS VOTING AT A SPECIAL ELECTION CALLED BY THE GOVERNING AUTHORITIES OF THE CITY OF CLARKSDALE, MISSISSIPPI; TO PROVIDE THAT IF A MAJORITY OF THE QUALIFIED ELECTORS VOTE TO ABOLISH THE COMMISSION, SUCH COMMISSION SHALL BE ABOLISHED 30 DAYS AFTER THE ELECTION IS CERTIFIED AND THE GOVERNING AUTHORITIES SHALL ASSUME CONTROL AND OPERATION OF THE CITY'S UTILITIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Notwithstanding the provisions of Section 27-27-15, Mississippi Code of 1972, the governing authorities of the City of Clarksdale, Mississippi, are authorized and empowered to call, by resolution, a special election on the question of abolishing the Clarksdale Public Utilities Commission.  The Clarksdale Public Utilities Commission shall be abolished and the governing authorities of the City of Clarksdale shall assume control and operation of the city's utilities thirty (30) days following the certification of the results of a special election called under this section if a majority of the qualified electors voting in the special election vote to abolish the Clarksdale Public Utilities Commission.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
