House Resolution 1

A RESOLUTION TO CREATE A HOUSE STUDY COMMITTEE ON CRIME AND CORRECTIONS.

     WHEREAS, the issues of crime and of our state's correctional system are integrally related to the well-being of the citizens of Mississippi; and

     WHEREAS, the House of Representatives finds that a comprehensive review of these issues should be undertaken during the interim between the 2010 and 2011 Regular Sessions of the Mississippi State Legislature:

     NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF MISSISSIPPI, That:

     (1)  There is created the House Study Committee on Crime and Corrections.

     (2)  The committee shall consist of the following:  Twelve (12) House members appointed by the Speaker of the House, which shall include at least one (1) member of the House Select Committee on Poverty, one (1) member of the House Judiciary "B" Committee and one (1) member of the House Corrections Committee.  The Speaker shall appoint the Chair and Vice Chair of the Study Committee on Crime and Corrections.

     (3)  The duties of the committee shall be as follows:

          (a)  Make recommendations at the 2011 Regular Session to the House of Representatives to facilitate the efficient and effective operation of the Department of Corrections; and

          (b)  Diligently inquire and fully examine the state's present and long-term needs in regard to the Department of Corrections.

     (4)  The committee may examine regularly all aspects of the operations of the Department of Corrections.  The committee, upon request, may examine any proposed correctional facility contract at least thirty (30) days before the beginning of the initial contract agreement or renewal contract agreement.  If the committee requests the Department of Corrections to submit proposed contracts for review, the department shall provide the proposed contracts and related contractual documents at least forty-five (45) days before the beginning of the contractual period.

     (5)  The committee or any of its individual members may make announced or unannounced inspections or visits to the Department of Corrections and its operations and facilities at any time.

     (6)  Upon request of the chair of the committee, any state agency shall provide any available legal or clerical assistance for the work of the committee.

     (7)  The committee may request that representatives of the Department of Public Safety and the Office of the State Auditor assist the committee in evaluating potential problem areas of the Department of Corrections.

     (8)  The members of the committee shall be paid from the contingent expense fund of the House in the same manner as provided for committee meetings when the Legislature is not in session and shall obtain the approval of the House Management Committee for per diem and travel expense expenditures of the committee; however, no per diem and expenses for attending meetings of the committee shall be paid while the Legislature is in session.

     (9)  Upon submitting its recommendation to the House at the 2011 Regular Session, the committee shall be dissolved.
