House Concurrent Resolution 8

A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO THE MISSISSIPPI CONSTITUTION OF 1890, TO ADD A NEW SECTION 35A TO PROVIDE THAT ANY PERSON WHO IS ELECTED TO THE LEGISLATURE IN OR AFTER THE 2011 GENERAL ELECTION SHALL NOT BE ELIGIBLE TO SERVE FOR MORE THAN TWENTY YEARS IN THE LEGISLATURE, WHETHER THOSE YEARS ARE CONSECUTIVE YEARS OF SERVICE OR NOT; AND FOR RELATED PURPOSES.

     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:

     Amend Article 4, Mississippi Constitution of 1890, by adding a new Section 35A to read as follows:

     "Section 35A.  Any person who is elected to office as a member of the Legislature in or after the 2011 general election shall not be eligible to serve for more than twenty (20) years in the Legislature, whether those years are consecutive years of service or not.  However, the years served in the Legislature by a member who is elected or appointed to serve less than a full legislative term to fill a vacancy in office shall not be included in the twenty-year limitation set forth in this section; but no member who has completed twenty (20) years in the Legislature is thereafter eligible to serve a partial term in the Legislature."

     BE IT FURTHER RESOLVED, That this proposed amendment shall be submitted by the Secretary of State to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2011 as provided by Section 273 of the Constitution and by general law.

     BE IT FURTHER RESOLVED, That the explanation of this proposed amendment for the ballot shall read as follows:  "This proposed amendment provides that any person who is elected to the Legislature in or after the 2011 general election shall not be eligible to serve for more than twenty years in the Legislature, whether those years are consecutive years of service or not."

     BE IT FURTHER RESOLVED, That the Attorney General of the State of Mississippi shall submit this resolution, immediately upon adoption by the Legislature and upon ratification by the qualified electors of this state, to the Attorney General of the United States or to the United States District Court for the District of Columbia, in accordance with the provisions of the Voting Rights Act of 1965, as amended and extended.
