AN ACT TO CREATE A FUND IN THE STATE TREASURY TO BE KNOWN AS THE "MUNICIPAL AND COUNTY STREET RECONSTRUCTION FUND"; TO PROVIDE THAT THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION SHALL PROMULGATE RULES AND REGULATIONS FOR DISTRIBUTION OF MONIES INTO THE FUND; TO PROVIDE THAT THE FUND SHALL CONSIST OF MONIES APPROPRIATED BY LINE ITEM IN THE APPROPRIATION TO THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION AND MONIES FROM ANY OTHER SOURCES; TO PROVIDE THAT THE FUND SHALL BE UTILIZED TO PROVIDE CERTAIN GRANTS TO MUNICIPALITIES AND COUNTIES THAT ADOPT ORDINANCES, POLICIES AND PROCEDURES TO CONSTRUCT OR RECONSTRUCT STREETS AND TRANSPORTATION FACILITIES; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) There is established in the State Treasury a fund to be known as the "Municipal And County Street Reconstruction Fund" which shall be administered by the Mississippi Department of Transportation. Such fund shall be used for the purposes established in subsection (3) of this section. The Department of Transportation shall promulgate regulations for the administration of the fund, which shall include: (a) an application procedure that qualifies a municipality or county to obtain funding, (b) an objective procedure for the Mississippi Department of Transportation to award funding; and (c) the requirements to qualify for such funding.
(2) The "Municipal And County Street Reconstruction Fund" shall consist of line item monies appropriated by the Legislature to the Mississippi Department of Transportation, specifically for the Municipal And County Street Reconstruction Fund, monies from federal or state grants and from any public or private source. Any interest which accrues from monies in the fund shall remain in the fund, and any monies remaining in the fund at the end of the fiscal year shall not lapse into the General Fund, but shall remain in the fund.
(3) The fund shall be used to distribute monies to municipalities and/or counties that adopt ordinances, policies and procedures to construct or reconstruct streets and transportation facilities. Monies shall be distributed based on the cost of the municipal or county project provided to the Mississippi Department of Transportation.
SECTION 2. This act shall take effect and be in force from and after July 1, 2015.
