House Bill 946

AN ACT TO CREATE NEW SECTION 41-10-5, MISSISSIPPI CODE OF 1972, TO REQUIRE HEALTH CARE PROVIDERS AND THEIR AGENTS TO PROVIDE MEDICAL AND BILLING RECORDS TO A PATIENT WITHIN A CERTAIN TIME AFTER RECEIVING A VALID REQUEST FROM THE PATIENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 41-10-5, Mississippi Code of 1972:

     41-10-5.  A health care provider or its agent(s) or both shall provide medical records and billing records that are in their possession or custody to the patient who is the subject of the records within thirty (30) days from the date that a valid request from the patient is received by the health care provider or its agent(s).  As used in this section, the term "medical records" shall have the meaning as defined in Section 41-10-3(1).

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2022.
