AN ACT TO CREATE SECTION 99-5-41, MISSISSIPPI CODE OF 1972, TO PROVIDE TO THE DISCHARGE OF A BAIL BOND; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 99-5-41, Mississippi Code of 1972:
A bail bond is discharged or cleared:
(a) If the defendant appears and is found to be guilty, the charge is dismissed or nolle prosequi, or the charge is retired or remanded to the files.
(b) If the defendant is tried in absentia and is found to be guilty and sentenced thereon.
(c) When the defendant is present in court and either pleads guilty or is found to be guilty and sentence is pronounced thereon.
(d) When the defendant is surrendered by the bail agent in open court or to the proper jail or the sheriff as required in Section 99-5-27.
(e) When a defendant is placed on a nonadjudication sentenced or ordered to take an alcohol or anger management class. SECTION 2. This act shall take effect and be in force from and after July 1, 2014.
