AN ACT TO PROVIDE THAT IT SHALL BE UNLAWFUL FOR ANY PERSON TO USE A FACSIMILE MACHINE FOR PURPOSES OF TRANSMITTING UNSOLICITED ADVERTISING MATERIAL FOR THE SALE OF ANY REAL PROPERTY, GOODS OR SERVICES; TO AUTHORIZE THE ATTORNEY GENERAL OR THE PUBLIC SERVICE COMMISSION TO IMPOSE CERTAIN PENALTIES AND INJUNCTIVE RELIEF FOR THE TRANSMITTAL OF SUCH MATERIAL; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) It is unlawful for any person to use a machine that electronically transmits facsimiles of documents through connection with a telephone network to transmit within this state unsolicited advertising material for the sale of any real property, goods or services.
(2) The Attorney General or the Public Service Commission may bring an action to impose a civil penalty and to seek injunctive relief. The civil penalty shall not exceed Five Hundred Dollars ($500.00) per violation. Each transmission shall be considered a separate violation.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
