House Bill 316

AN ACT TO AMEND SECTION 97-29-47, MISSISSIPPI CODE OF 1972, TO REVISE THE OFFENSE OF PUBLIC DRUNKENNESS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 97-29-47, Mississippi Code of 1972, is amended as follows:

     97-29-47.  If any person shall profanely swear or curse, or use vulgar and indecent language, or be drunk in any public place, in the presence of two (2) or more persons, and has caused a disturbance for which at least two (2) persons who are not law enforcement officers shall sign an affidavit to that effect, he shall, on conviction thereof, be fined not more than One Hundred Dollars ($100.00) or be imprisoned in the county jail not more than thirty (30) days or both.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2014.
