AN ACT TO PROVIDE THAT EMERGENCY CONTRACEPTION SHALL BE DISPENSED OR SOLD TO PERSONS UNDER EIGHTEEN YEARS OLD ONLY UPON THE PRESCRIPTION OF AN AUTHORIZED HEALTH CARE PROFESSIONAL, EXCEPT WHEN DISPENSED DIRECTLY TO THE PERSON BY THE HEALTH CARE PROFESSIONAL; TO DIRECT THE STATE BOARD OF PHARMACY TO ADOPT AND ENFORCE REGULATIONS REGARDING THE DISPENSING AND SALE OF EMERGENCY CONTRACEPTION IN PHARMACIES TO ENSURE THAT EMERGENCY CONTRACEPTION IS NOT DISPENSED OR SOLD TO PERSONS UNDER EIGHTEEN YEARS OLD WITHOUT A PRESCRIPTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  As used in this section, "emergency contraception" means a medication or combination of medications approved by the United States Food and Drug Administration to be taken or used after sexual intercourse for the prevention of pregnancy by preventing ovulation, fertilization of an egg, or implantation of an egg in a uterus.

     (2)  Emergency contraception shall be dispensed or sold to persons under eighteen (18) years old only upon the prescription of an authorized health care professional within the scope of his or her practice, except when dispensed directly to the person by the health care professional.  The State Board of Pharmacy shall adopt and enforce regulations regarding the dispensing and sale of emergency contraception in pharmacies to ensure that emergency contraception is not dispensed or sold to persons under eighteen (18) years old without a prescription.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2014.
