House Bill 1742

AN ACT TO AUTHORIZE THE BOARD OF MAYOR AND COMMISSIONERS OF THE CITY OF CLARKSDALE, MISSISSIPPI, TO REQUEST THE CLARKSDALE PUBLIC UTILITIES COMMISSION TO TRANSFER CERTAIN FUNDS TO THE BOARD OF MAYOR AND COMMISSIONERS; TO PROVIDE THAT SUCH TRANSFERRED FUNDS MAY BE USED FOR ANY MUNICIPAL PURPOSE FOR DISTRIBUTION TO THE VARIOUS MUNICIPAL FUNDS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Board of Mayor and Commissioners of the City of Clarksdale is authorized, in its discretion, by resolution, to request funds from the Clarksdale Public Utilities Commission in an amount not to exceed six percent (6%) of total operating revenue as determined by the prior fiscal year audit.  The Clarksdale Public Utilities shall transfer the amount requested per the resolution, less any amounts provided to the City of Clarksdale as free services pursuant to Section 21-27-27, Mississippi Code of 1972.  The transferred funds may be used by the Board of Mayor and Commissioners for any lawful municipal purpose and may be distributed to the various municipal funds.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
