House Bill 1528

AN ACT TO PROVIDE THAT WHEN CERTAIN PEOPLE ARE REQUIRED TO BE RESCUED FROM A NAVIGABLE WATER IN THE STATE, THE BOARD OF SUPERVISORS OR GOVERNING AUTHORITY WHERE THE RESCUE OCCURRED SHALL VOTE TO DETERMINE WHETHER THOSE PEOPLE SHALL BE REQUIRED TO PAY A FINE THAT EQUALS THE COST OF THE RESCUE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Notwithstanding any other provision of law, if a person or group of people require rescue from a navigable water in this state and such rescue would not have been required but for the person or group of people's negligent behavior, then the local rescuing entity shall make a report to either the board of supervisors or governing authority where the rescue occurred.  At the next regular meeting of the board of supervisors or governing authority, the members shall vote to determine, based on the report of the local rescuing entity, whether a fine shall be assessed to the person or group of people who would not have been required to be rescued but for their negligent behavior.  If the board of supervisors or governing authority vote in favor of issuing a fine to those people, then the fine shall be equal to the cost to the local rescuing entity of the rescue.  The board of supervisors of any county and the governing authority of any municipality shall have the authority to charge the fines assessed in this section. 

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
