AN ACT TO PROVIDE FOR A STATEWIDE ELECTION FOR THE PURPOSE OF DETERMINING WHETHER TO INCREASE THE SALES TAX, GASOLINE EXCISE TAX AND THE SPECIAL FUEL EXCISE TAX ON UNDYED DIESEL FUEL; TO PROVIDE THAT THE INCREASE SHALL BE UTILIZED FOR IMPROVEMENTS IN INFRASTRUCTURE; TO PROVIDE THAT PASSAGE OF THE REFERENDUM SHALL OCCUR IF SIXTY PERCENT OF THE QUALIFIED ELECTORS WHO VOTE IN THE ELECTION VOTE IN FAVOR OF THE INCREASE IN THE TAXES; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) There shall be a statewide election for the purpose of determining whether to increase the sales tax, gasoline excise tax and the special fuel excise tax on undyed diesel fuel for improvements in infrastructure, to be held in November of 2018, and conducted during the regular general election. The question put before the voters at such statewide election shall have printed on the ballot a brief description of the sales tax, gasoline excise tax and special fuel excise tax on undyed diesel fuel, the description of the purposes for which the tax increase may be used and expended and the words "FOR THE INCREASE IN TAXES" and, on a separate line, "AGAINST THE INCREASE IN TAXES" and the voters shall vote by placing a cross (X) or check (�) opposite their choice on the proposition. Passage of the referendum shall occur if sixty percent (60%) of the qualified electors who vote in the election vote in favor of the tax.
(2) The county election commissioners shall transmit to the Secretary of State, in the same manner as the vote for state officers is transmitted, a statement of the total number of votes cast for each proposition in the statewide election. The Secretary of State shall tabulate such returns and certify the results to the Governor and to each house of the Legislature.
SECTION 2. This act shall take effect and be in force from and after July 1, 2017.
