House Bill 1363

AN ACT TO ESTABLISH PROCEDURES IN CAUSES OF ACTION FOR ALIENATION OF AFFECTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  No act of the defendant shall give rise to a cause of action for alienation of affection that occurs after the plaintiff and the plaintiff's spouse physically separate with the intent of either the plaintiff or plaintiff's spouse that the physical separation remain permanent.

     (2)  An action for alienation of affection shall not be commenced more than three (3) years from the last act of the defendant giving rise to the cause of action.

     (3)  A person may commence a cause of action for alienation of affection against a natural person only.

     (4)  This act shall apply to all pending and future causes of action for alienation of affection.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2022.
