House Bill 1363

AN ACT TO CODIFY NEW SECTION 67-3-44, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT RETAILERS OF BEER AND LIGHT WINES ARE PROHIBITED FROM ACTING AS OR MAKING LOANS TO WHOLESALERS, DISTRIBUTORS OR MANUFACTURERS OF LIGHT WINES AND BEER; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 67-3-44, Mississippi Code of 1972: 

     67-3-44.  (1)  The provisions of subsection (2) of this section apply to the following individuals and entities:

          (a)  Any person engaged in the business of selling beer and/or light wines at retail;

          (b)  An owner, shareholder, stockholder, member, partner, officer or director of an entity described in paragraph (a) of this subsection;

          (c)  An affiliate of an entity described in paragraph (a) of this subsection, regardless of whether the affiliation is corporate or by management, direction or control.

     (2)  No entity named in subsection (1) of this section may have any interest, direct or indirect, in, or lien upon, the license, business, assets or corporate stock of a wholesaler, distributor or manufacturer of beer and/or light wines.

     (3)  No entity named in subsection (1) of this section may make any loan, directly or indirectly, to any wholesaler, distributor or manufacturer of beer and/or light wines.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2014.
