MISSISSIPPI LEGISLATURE

House Bill 1277

AN ACT TO CREATE NEW SECTIONS 41-28-7 AND 41-28-9, MISSISSIPPI CODE OF 1972, TO REQUIRE THE STATE DEPARTMENT OF HEALTH TO PREPARE ANNUAL ACTION PLANS FOR THE CONTROL AND PREVENTION OF DIABETES AND OBESITY IN THE STATE; TO PRESCRIBE THE INFORMATION TO BE INCLUDED IN SUCH PLANS; TO REQUIRE THE PLANS TO BE SUBMITTED TO THE SENATE COMMITTEE ON PUBLIC HEALTH AND WELFARE AND THE HOUSE COMMITTEE ON PUBLIC HEALTH AND HUMAN SERVICES NO LATER THAN FEBRUARY 1; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 41-28-7, Mississippi Code of 1972:

     41-28-7.  (1)  The State Department of Health shall submit an annual action plan to the Senate Committee on Public Health and Welfare and the House Committee on Public Health and Human Services no later than February 1 of each year on the following:

          (a)  The financial impact and reach diabetes of all types are having on the State of Mississippi and its residents. Items in this assessment shall include:

               (i)  The number of individuals diagnosed with diabetes covered by the State Department of Health, its contracted partners and other stakeholders;

               (ii)  The number of individuals diagnosed with diabetes impacted by the prevention and diabetes control programs implemented by the department, its contracted partners and other stakeholders;

               (iii)  The financial costs diabetes and its complications place on the department, its contracted partners and other stakeholders; and

               (iv)  The financial costs diabetes and its complications place on the department, its contracted partners and other stakeholders in comparison to other chronic diseases and conditions for which the state collects data;

          (b)  An assessment of the benefits of implemented programs and activities directed toward controlling and preventing diabetes;

          (c)  A description of the level of coordination existing between the State Department of Health, its contracted partners and other stakeholders on activities, programmatic activities and the level of communication on managing, treating or preventing all forms of diabetes and its complications;

          (d)  The development of a detailed action plan for battling diabetes with a range of actionable items.  The plan shall identify proposed action steps to reduce the impact of diabetes, pre-diabetes and related complications.  The plan shall identify expected outcomes of the action plan proposed while establishing benchmarks for controlling and preventing diabetes; and

          (e)  The development of a detailed budget blueprint identifying needs, cost, and resources to implement the plan identified in paragraph (d) of this subsection.

     (2)  (a)  The State Department of Health shall develop a voluntary protocol for licensed medical practitioners consisting of clinical quality and performance measures for the treatment of patients with diabetes.

          (b)  The clinical quality and performance measures shall include:

               (i)  Glycated hemoglobin (A1c) control;

               (ii)  Low density lipoprotein control;

               (iii)  High blood pressure control;

               (iv)  Hypoglycemia control; and

               (v)  Tobacco nonuse.

     SECTION 2.  The following shall be codified as Section 41-28-9, Mississippi Code of 1972:

     41-28-9.  (1)  The State Department of Health shall submit an annual action plan to the Senate Committee on Public Health and Welfare and the House Committee on Public Health and Human Services no later than February 1 of each year on the following:

          (a)  The financial impact and reach obesity is having on the State of Mississippi and its residents.  Items in this assessment shall include:

               (i)  The number of individuals diagnosed with obesity covered by the State Department of Health, its contracted partners and other stakeholders;

               (ii)  The number of individuals diagnosed with obesity impacted by the prevention and diabetes control programs implemented by the department, its contracted partners and other stakeholders;

               (iii)  The financial costs obesity and its complications place on the department, its contracted partners and other stakeholders; and

               (iv)  The financial costs obesity and its complications place on the department, its contracted partners and other stakeholders in comparison to other chronic diseases and conditions for which the state collects data;

          (b)  An assessment of the benefits of implemented programs and activities directed toward controlling and preventing obesity;

          (c)  A description of the level of coordination existing between the State Department of Health, its contracted partners and other stakeholders on activities, programmatic activities and the level of communication on managing, treating or preventing obesity and its complications;

          (d)  The development of a detailed action plan for battling obesity with a range of actionable items.  The plan shall identify proposed action steps to reduce the impact of obesity and related obesity complications.  The plan shall identify expected outcomes of the action plan proposed while establishing benchmarks for controlling and preventing obesity; and

          (e)  The development of a detailed budget blueprint identifying needs, cost, and resources to implement the plan identified in paragraph (d) of this subsection.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2014.
