House Bill 1267

AN ACT TO REQUIRE NURSING FACILITIES TO UPDATE THE CHART OF EACH RESIDENT OF THE NURSING FACILITY EACH DAY WITH DOCUMENTATION OF ALL ACTIONS TAKEN BY PERSONNEL OF THE NURSING FACILITY WITH REGARD TO THE RESIDENT DURING THAT DAY; TO PROVIDE FOR A FINE FOR EACH OCCURRENCE OF FAILURE TO PROPERLY UPDATE A RESIDENT'S CHART; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The State Board of Health shall adopt rules and regulations that require nursing facilities licensed under Section 43-11-1 et seq. to update the chart of each resident of the nursing facility each day with documentation of all actions taken by personnel of the nursing facility with regard to the resident during that day, and provide that any nursing facility that fails to properly update a resident's chart shall be fined Five Hundred Dollars ($500.00) for each occurrence.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
