AN ACT TO PROHIBIT STATE AND LOCAL GOVERNING AUTHORITIES AND POLITICAL SUBDIVISIONS OF THE STATE FROM KNOWINGLY PERMITTING THE USE OF PUBLIC PROPERTY UNDER THEIR RESPECTIVE JURISDICTION BY PERSONS, ENTITIES AND ORGANIZATIONS AFFILIATED WITH ORGANIZED CRIMINAL ACTIVITY AND WHO ARE LISTED ON THE REGISTER MAINTAINED BY THE MISSISSIPPI OFFICE OF HOMELAND SECURITY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. No state, county or local governing authority, agency, municipal office, county office or any other political subdivision of this state shall knowingly permit the use of any public building, grounds or other real property over which such authorities or political subdivisions have jurisdiction to any person, entity or organization known and identified as being affiliated with any criminal organization or organized crime, as indicated by such person, entity or organization's inclusion on the register maintained by the Mississippi Office of Homeland Security. The prohibition on a governing authority's ability to allow the use of such real property by such persons, entities or organizations shall be construed as a reasonable objective to protect the safety and welfare of the citizens of this state and to abate the advancement of organized criminal activity.
SECTION 2. This act shall take effect and be in force from and after July 1, 2016.
