House Bill 1201

AN ACT TO REQUIRE LAW ENFORCEMENT OFFICERS TO UNDERGO A PSYCHOLOGICAL EVALUATION EVERY TWO YEARS; TO AUTHORIZE THE ATTORNEY GENERAL TO PROMULGATE RULES AND REGULATIONS TO CARRY OUT THE PROVISIONS OF THIS ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  All law enforcement officers shall undergo a psychological evaluation to determine the state of the mental health of such law enforcement officer every two (2) years by a licensed psychologist.  The evaluation to determine the state of the mental health of such law enforcement officer shall include drug and substance abuse testing.  The Attorney General shall hire a psychologist to perform the evaluations required by this section and shall promulgate any necessary rules and regulations to carry out the provisions of this section.  Failure of a law enforcement officer to have such evaluation performed shall result in suspension without pay.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
