House Bill 1191

AN ACT TO REQUIRE PERIODIC DRUG TESTING OF LAW ENFORCEMENT OFFICERS AS DETERMINED BY THE ATTORNEY GENERAL; TO REQUIRE BIDDING FOR THE CONTRACT TO PERFORM SUCH TESTING; TO AUTHORIZE THE ATTORNEY GENERAL TO PROMULGATE RULES AND REGULATIONS TO CARRY OUT THE PROVISIONS OF THIS ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  All law enforcement officers shall be subject to periodic drug testing as determined by the Attorney General.  The Attorney General shall solicit bids from independent companies to conduct drug testing of law enforcement officers throughout the state.  The company with the lowest and best bid shall be selected as provided by law and a contract shall be entered upon such terms as the Attorney General and the company negotiate.

     (2)  The Attorney General shall promulgate any necessary rules and regulations necessary to carry out the provisions of this section no later than sixty (60) days after the effective date of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
