House Bill 1142
AN ACT TO AMEND SECTION 61-13-1, MISSISSIPPI CODE OF 1972, TO REQUIRE LEGISLATIVE APPROVAL FOR THE PURCHASE OR LEASE OF ANY STATE AIRCRAFT; TO AMEND SECTION 61-13-5, MISSISSIPPI CODE OF 1972, IN CONFORMITY TO THE PROVISIONS OF THIS ACT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 61-13-1, Mississippi Code of 1972, is amended as follows:
61-13-1. (1) The Department of Finance and Administration of the State of Mississippi may purchase or lease in accordance with subsection (2) of this section, operate and maintain nonmilitary aircraft for use by the Governor's Office, state departments, agencies, boards and commissions, the Legislature, its officers and employees, all under the general direction of the Department of Finance and Administration.
(2) Before the department may purchase or lease aircraft for the purpose of state use, the proposed purchase or lease must be approved by general law enacted by the Legislature.
SECTION 2. Section 61-13-5, Mississippi Code of 1972, is amended as follows:
61-13-5. All purchases of airplanes, supplies and other necessary equipment for the successful operation of the aforesaid airplanes shall be purchased in strict compliance with Sections 25-1-77, 25-1-85, 25-1-89 and 31-7-1 through 31-7-21, and all purchases or leases of airplanes or other aircraft must be approved by the Legislature as provided in Section 61-13-1(2).
SECTION 3. This act shall take effect and be in force from and after July 1, 2011.
