House Bill 1130

AN ACT TO AUTHORIZE A PARENT OR LEGAL GUARDIAN OF A CHILD WITH A MENTAL ILLNESS TO MAINTAIN CONTROL AND CUSTODY OF SUCH CHILD UNTIL THE AGE OF TWENTY-SIX; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  A parent of legal guardian of a child who has a severe mental illness or who poses a threat to himself or others is authorized to maintain control and custody of such child whether in an institution or not, up to the age of twenty-six (26) years of age on an involuntary basis in accordance with the provisions of the Affordable Health Care Act or under the parent of legal guardian's health insurance policy or plan.  The provisions of this section shall be deemed to be in addition and supplemental to any provision of law providing for commitment or care of a person with mental illness or a person with an intellectual disability as those terms are defined in Section 41-21-61.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
