AN ACT TO AUTHORIZE THE UNIVERSITY OF MISSISSIPPI MEDICAL CENTER TO GUARANTEE THE FINANCIAL OBLIGATIONS OF AN ENTITY THAT IS FORMED TO ACQUIRE, CONSTRUCT, EQUIP, AND FINANCE A PROTON THERAPY CENTER OR AN AFFILIATE OF SUCH ENTITY; TO PROVIDE THAT THE PRINCIPAL AMOUNT OF ANY INDEBTEDNESS GUARANTEED DIRECTLY OR INDIRECTLY SHALL NOT EXCEED THIRTY MILLION DOLLARS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  As used in this section, the term "proton therapy center" means a facility, or group of facilities, the primary purpose of which is to undertake medical treatment and research relating to the use of beams of protons to irradiate diseased tissue to treat cancer and other diseases.

     (2)  The University of Mississippi Medical Center is authorized to guarantee the financial obligations of an entity that is formed to acquire, construct, equip, and finance a proton therapy center or an affiliate of such entity, provided that the principal amount of any indebtedness guaranteed directly or indirectly under this section shall not exceed Thirty Million Dollars ($30,000,000.00).

     (3)  The Legislature finds and determines that the acquisition, construction, equipping, and financing of a proton therapy center that is affiliated with the University of Mississippi Medical Center through such an entity or its affiliate will support the mission of the medical center by offering research and training opportunities to its faculty and students, will provide access to health care opportunities in the state, which will benefit citizens of the state, and will support the economic growth of the state through the availability of advanced medical treatments and through research and development activities related to such treatments, including commercialization of research outcomes. Therefore, the Legislature finds and determines that the execution of any guaranty as authorized by this section fulfills an essential public purpose.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2016.
