House Bill 1109

AN ACT TO PROVIDE THAT IT IS A MISDEMEANOR TO VIOLATE THE POSTED NONSMOKING POLICY OF A BUSINESS OR SERVICE ESTABLISHMENT THAT IS LOCATED IN A COUNTY OR MUNICIPALITY THAT DOES NOT HAVE AN ORDINANCE PROHIBITING SMOKING; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  If a business or service establishment that is open to the public is located in a county or municipality that does not have an ordinance prohibiting smoking, and the establishment has a policy prohibiting smoking in the facilities of the establishment and has posted prominent signs at the entrance of and within the facilities stating that smoking is prohibited in those facilities and that violations are punishable as a misdemeanor, then any person who violates the posted nonsmoking policy of the establishment is guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than Twenty-five Dollars ($25.00) nor more than Fifty Dollars ($50.00) for each such offense.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
