House Bill 1043

AN ACT TO REQUIRE THE MISSISSIPPI DEPARTMENT OF FINANCE AND ADMINISTRATION, IN CONJUNCTION WITH EVERY STATE AGENCY OR POLITICAL SUBDIVISION OF THE STATE WITH AN OFFICE BUILDING LOCATED WITHIN THE CAPITOL COMPLEX, SITUATED IN DOWNTOWN JACKSON, HINDS COUNTY, MISSISSIPPI, SHALL PROVIDE BOTH SHORT-TERM AND LONG-TERM BICYCLE PARKING RACKS OR STATIONS IN OR AT ALL GOVERNMENT BUILDINGS OR PARKING LOTS UNDER THE DEPARTMENT'S JURISDICTION; TO PRESCRIBE THE REQUIREMENTS FOR SHORT-TERM AND LONG-TERM BICYCLE PARKING ACCOMMODATION REQUIREMENTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Mississippi Department of Finance and Administration, in conjunction with every state agency or political subdivision of the state with an office building located within the Capitol Complex, situated in downtown Jackson, Hinds County, Mississippi, shall provide both short-term and long-term bicycle parking racks or stations in or at all government buildings or parking lots under the department's jurisdiction, as provided in Section 29-5-2.  Bicycle parking racks shall be provided at a rate of ten percent (10%) of the required parking available on the premises of each government office's designated vehicle parking site.  However, short-term and long-term bicycle parking shall consist of no less than five (5) spaces each for each government office.

     (2)  (a)  Short-Term Bicycle Parking.  Short-term bicycle

parking shall consist of bicycle racks that support the bicycle frame at two (2) points.  Racks that support only the wheel of the bicycle are not permissible.  Additionally:

               (i)  Racks shall allow for the bicycle frame and at

least one (1) wheel to be locked to the racks;

               (ii)  The bicycle rack shall allow for the use of a

cable as well as a U-shaped lock.

               (iii)  If bicycles can be locked to each side of the rack, each side shall be counted toward a required space;

               (iv)  Racks shall be securely anchored to a

permanent surface; and

               (v)  If more than twenty (20) short-term bicycle parking spaces are provided, at least fifty percent (50%) of those spaces shall be covered by a roof or overhang.

          (b)  Long-Term Bicycle Parking.  Long-term bicycle

parking shall be secured from the general public and enclosed on

all sides and protect bicycles from inclement weather.  Acceptable examples of long-term bicycle parking include bicycle lockers, bicycle rooms or bicycle cages or commercially operated attended bicycle facilities.  All long-term parking shall provide a means of securing the bicycle frame at two (2) points to a securely anchored rack.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2023.
