House Bill 1025

AN ACT TO AMEND SECTION 33-7-315, MISSISSIPPI CODE OF 1972, TO CREATE THE STATE ACTIVE DUTY EMERGENCY OPERATIONS FUND AS A SPECIAL FUND IN THE STATE TREASURY FOR THE PAYMENT OF ALL EXPENSES INCURRED BY THE NATIONAL GUARD WHEN IT IS ORDERED OUT FOR STATE ACTIVE DUTY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 33-7-315, Mississippi Code of 1972, is amended as follows:

     33-7-315.  Whenever the National Guard, or any part thereof, is ordered out for * * *active state active duty, all expenses incurred in * * *such that service shall be paid from funds * * *of the State of Mississippi not otherwise appropriated in the State Active Duty Emergency Operations Fund that is created as a special fund in the State Treasury.  The fund shall consist of monies appropriated, transferred or otherwise made available for deposit in the fund by the Legislature, and monies designated for deposit in the fund from any other source, public or private.  Monies in the fund shall be expended by the Military Department, upon appropriation by the Legislature.  Unexpended amounts remaining in the fund at the end of the fiscal year shall not lapse into the State General Fund, and any interest earned or investment earnings on amounts in the fund shall be deposited to the credit of the fund.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2017.
